NTESU’s statement of support for Fazel Khan
Dear NTESU Members,
Many of you have approached us for a response to the dismissal of Fazel Khan. We have chosen to respond now, having carefully read the judgement published by the Management and having followed with interest the various debates on the issue in e-mail fora around the University.
Overall the decision to dismiss Khan, who has been a union leader and a prominent social activist for more than a decade, is being perceived as further proof that UKZN has an intimidatory management that is stifling free debate about University governance. It is in this light that we voice our objection to the proceedings of the Fazel Khan case:
- Firstly, the apparent climate of fear and intimidation at UKZN that mitigated against a fair hearing.
- Secondly, the application of the ultimate penalty of dismissal.
- Thirdly, a perceived inconsistency where witness evidence was given more weight than Khan’s denial.
Finally, that the leaking of the Governance Task Team Report occurred after the deadline by which it should have been tabled before Council. We note with increasing concern that this important report has still not been properly presented to Council (as was agreed in the Strike settlement) more than 8 months later.
We have no doubt that the damage to the reputation of our university, which should be a place of independent thought and open debate, is considerable. The ironic words chosen by the presiding officer to describe the effect of Mr Khan’s action as she sees it:
‘A reasonable person reading the information would come to the conclusion that the university environment is repressive and that it is without the foundational values of the Constitution.’
Seem to apply equally aptly to the effects of the disciplinary action itself. In light of the above, we call on the university management to:
- Make good the injustice done to Fazel Khan
- Immediately disseminate the Governance Task Team Report to the entire university community
- Inform the university community of the steps that are being taken to remedy the problems identified in that report.
